These Terms of Service ("Terms") govern your access to and use of the websites, mobile applications, and services (collectively, the "Services") provided by Salient Media LLC, a Georgia limited liability company, doing business as Suhoor Festival ("Suhoor Festival," "we," "us," or "our").

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old to use the Services. If you are under 18, you must have permission from a parent or legal guardian. By using the Services you represent that you meet these requirements and have the right and authority to enter into these Terms.

2. Your Account

To access certain features you may need to create an account. You agree to:

Provide accurate, current, and complete information.
Keep your password confidential and secure.
Notify us immediately of any unauthorized access or use.
Take responsibility for all activity that occurs under your account.

3. License to Use the Services

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use. You may not copy, modify, distribute, sell, or lease any part of the Services, or reverse-engineer or attempt to extract source code, except where permitted by law.

4. Tickets and Purchases

Tickets to Suhoor Festival and World Festival events are sold exclusively through the App. All sales are final. Tickets are non-refundable but transferable through the App in accordance with our then-current transfer policy. By purchasing a ticket you agree to applicable venue rules, security screening, and our event code of conduct. We reserve the right to refuse entry, eject attendees, or cancel tickets in our sole discretion for safety, security, or policy violations.

Prices, fees, and taxes are displayed at checkout. Payment is processed by our third-party payment processor. We do not store full payment-card information on our servers.

5. Vendor Applications and Listings

Vendor applications are reviewed at our discretion. Submission of an application does not guarantee acceptance. Approved vendors agree to comply with all event rules, halal certification requirements, food-safety regulations, and any vendor agreement provided at onboarding. We reserve the right to revoke vendor status for non-compliance.

6. User Content

You retain ownership of content you submit through the Services ("User Content"), including photos, videos, reviews, and comments. By submitting User Content you grant Suhoor Festival a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, distribute, modify, and create derivative works of your User Content in connection with operating and promoting the Services and our events.

You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate any third party's rights or applicable law. We may, but are not obligated to, review, remove, or refuse to display User Content that we believe violates these Terms or is otherwise objectionable.

7. Prohibited Conduct

You agree not to:

Violate any applicable law, regulation, or third-party right.
Use the Services to harass, threaten, defame, or harm any person.
Post or share content that is unlawful, hateful, sexually explicit, or otherwise objectionable.
Impersonate any person or entity or misrepresent your affiliation.
Attempt to gain unauthorized access to the Services, accounts, computer systems, or networks.
Interfere with or disrupt the Services or any servers or networks connected to the Services.
Use automated tools (bots, scrapers) to access the Services without our prior written permission.
Resell, scalp, or transfer tickets outside the App.
Engage in fraudulent activity, including chargebacks for legitimate purchases.

8. Contests and Giveaways

Contests, giveaways, and promotions offered through the Services may be subject to additional rules disclosed at the time of the promotion. By entering you agree to those rules and to these Terms. Winners may be required to verify identity and eligibility before receiving prizes.

9. Third-Party Services

The Services may integrate with or link to third-party services (e.g., Apple Pay, Google Pay, social networks, maps). Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services.

10. Intellectual Property

All content, trademarks, logos, designs, software, and other materials provided through the Services (excluding User Content) are owned by or licensed to Suhoor Festival and are protected by copyright, trademark, and other intellectual-property laws. You may not use any of our trademarks or branding without our prior written permission.

11. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICES. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL SUHOOR FESTIVAL, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $100.

13. Indemnification

You agree to indemnify, defend, and hold harmless Suhoor Festival and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Services, your User Content, or your breach of these Terms.

14. Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice. Upon termination your right to use the Services ceases immediately. Sections that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and dispute resolution) will survive.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Gwinnett County, Georgia, and you consent to the personal jurisdiction of those courts. To the extent permitted by law, you and Suhoor Festival each waive any right to a jury trial.

16. Changes to These Terms

We may modify these Terms from time to time. If we make material changes we will notify you through the Services or by email and update the "Last updated" date above. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

17. Apple App Store Additional Terms

If you download the App from the Apple App Store, you acknowledge that these Terms are between you and Suhoor Festival, not Apple, and Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support. Apple is a third-party beneficiary of these Terms and may enforce them against you. You also agree to comply with Apple's Usage Rules in the Apple Media Services Terms.

18. Google Play Additional Terms

If you download the App from Google Play, you acknowledge that Google is not a party to these Terms and is not responsible for the App. Your use of the App is also subject to the Google Play Terms of Service.
